9月双语法规解读：《大气污染防治法》

　第一百一十七条 违反本法规定，有下列行为之一的，由县级以上人民政府环境保护等主管部门按照职责责令改正，处一万元以上十万元以下的罚款;拒不改正的，责令停工整治或者停业整治：

Article 117 Any violator of this Law for any of the following acts shall be ordered to make rectification by the competent department for environmental protection of the people's government at or above the county level pursuant to its duty, and shall also be fined 10,000 Yuan up to 100,000 Yuan; and if it refuses to make corrections, it shall be ordered to suspend production or operation and rectify.

　　(一)未密闭煤炭、煤矸石、煤渣、煤灰、水泥、石灰、石膏、砂土等易产生扬尘的物料的;

Firstly, the materials easily diffusing dust without adopting sealing measures, such as coal, coal gangue, coal cinder, coal ash, cement, lime, oulopholite and sandy soil;

　　(二)对不能密闭的易产生扬尘的物料，未设置不低于堆放物高度的严密围挡，或者未采取有效覆盖措施防治扬尘污染的;

secondly, regarding to the unsealed materials easily diffusing dust, the enclosure board whose height shall not be lower than the piled materials has not established, or effective covering measures have not been taken to prevent and control the dust pollution;

　　(三)装卸物料未采取密闭或者喷淋等方式控制扬尘排放的;

thirdly, measures of sealing or watering for the unloading materials have not been taken to control the dust emission;

　　(四)存放煤炭、煤矸石、煤渣、煤灰等物料，未采取防燃措施的;

fourthly, when storing coal, coal gangue, coal cinder, coal ash and other materials, the fire-prevention measures have not been taken;

　　(五)码头、矿山、填埋场和消纳场未采取有效措施防治扬尘污染的;

fifthly, the effective measures for preventing and controlling dust have not been taken at the quayside, the mine, the landfill and the disposal site;

　　(六)排放有毒有害大气污染物名录中所列有毒有害大气污染物的企业事业单位，未按照规定建设环境风险预警体系或者对排放口和周边环境进行定期监测、排查环境安全隐患并采取有效措施防范环境风险的;

sixthly, any enterprise or institution that discharges any toxic and harmful atmospheric pollutants listed in the Catalogue of Toxic and Harmful Atmospheric Pollutants fails to establish the early warning system for environmental risks, or fails to carry out the regular monitoring in accordance with the emission point and the surrounding environment, to inspect the risks of environmental safety and to take effective measures to prevent and control environmental risks;

　　(七)向大气排放持久性有机污染物的企业事业单位和其他生产经营者以及废弃物焚烧设施的运营单位，未按照国家有关规定采取有利于减少持久性有机污染物排放的技术方法和工艺，配备净化装置的;

seventhly, any enterprise, institution, other producing operator that discharges persistent organic pollutants into the atmosphere, or any business unit with waste-burning facilities fails to take the technical method and process to reduce the emission of persistent organic pollutants in accordance with relevant regulations of the State, and fails to equip the purification facility;

　　(八)未采取措施防止排放恶臭气体的。

    eighthly, failing to take measures to prevent the emission of obnoxious gas.

　第一百二十三条 违反本法规定，企业事业单位和其他生产经营者有下列行为之一，受到罚款处罚，被责令改正，拒不改正的，依法作出处罚决定的行政机关可以自责令改正之日的次日起，按照原处罚数额按日连续处罚：

Article 123 Any enterprise, institution or other producing operator that has any of the following acts in violation of this Law shall be fined and ordered to make corrections; if it refuses to make corrections, the administrative department making the decision of the fine penalty according to law shall penalize the offender to be fined the consecutive daily penalty according to the original penalty amount as of the day when the correction was ordered to make.

　　(一)未依法取得排污许可证排放大气污染物的;

Firstly, failing to get the emission license for atmospheric pollutants according to law;
　　(二)超过大气污染物排放标准或者超过重点大气污染物排放总量控制指标排放大气污染物的;

secondly, the emission of atmospheric pollutants fails to meet the emission standards of atmospheric pollutants or the control index of the total emission amount of atmospheric pollutants;
　　(三)通过逃避监管的方式排放大气污染物的;

thirdly, discharging atmospheric pollutants by evading the supervision;
　　(四)建筑施工或者贮存易产生扬尘的物料未采取有效措施防治扬尘污染的。

fourthly, failing to take effective measures to prevent and control the dust pollution at construction places or places storing materials that easily generates dust.

解读与分析：通读环《大气污染防治法》，可以清楚地看到大气污染防治工作突破了地域的限制而倾向于采取联合行动；也突破了“达标概念”的限制，向环境质量提升靠拢，即企业必须切实地减少污染物，而不再仅仅以达标为目标。因此，采取措施是必须的，达标排放并控制在总量之内只是这些要求的必然结果。

Interpretation and analysis: reading through the Law of the People's Republic of China on the Prevention and Control of Atmospheric Pollution, it can be clearly seen that the prevention and control of the atmospheric pollution has broken the regional restrictions with the tendency to take joint actions. What’s more, it has broken the limitation of the “to-reach-the-standard” concept and has gradually working its way towards the quality of the environment; in other words, enterprises shall effectively reduce the pollutants rather than just simply reach the standards. Therefore, it is necessary to take some measures, and it is the inevitable result that the emission amount shall meet the standard and be controlled within the total amount.

可以说，延续《环境保护法》的要求，企业的环境保护工作将被引导向一个主动体符合环保法规、提升环境质量要求、满足居民诉求的方面发展。企业的压力将不仅来自于法规、更多来自于老百姓对环境质量的不满。

It can be said that, for this Law can be deemed as the continuation of the Environmental Protection Law, environmental protectors in enterprises will be guided to become volunteers to obey the environmental protection laws and regulations, to improve the environmental quality and to satisfy the public's requirements. Enterprises' pressures will not only come from laws and regulations, but more from people’s dissatisfaction with the quality of the environment.
